Agreement reserving property of both for themselves subject to certain payments to wife.

 

Agreement made this _________, 19__, between A, of _________, and B, of _________.

Recitals:

A marriage is contemplated between the parties, and the object of the pecuniary condition and situation, their prospects and desires, and mutual rights and obligations, having been fully considered, they agree, each with the other, and to which they respectively bind themselves, their heirs, executors, and administrators as follows:

1. A, in consideration of the promise of B to marry him, and of the consummation of proposed marriage, and of her agreements contained in this agreement, agrees that he will, upon his decease, pay or cause to be paid, or provide that there shall be paid, to her, if she is then living, $_____ within _________ months after his death; and as a further consideration B waives, disclaims, and releases, all right, title and interest in and to any and all real and personal property owned or possessed by A at the time of the marriage, or he may acquire by any means, and in which he may or might lawfully and rightfully acquire any title or interest by virtue of the marriage. A acknowledges that he knows that B is the owner of a residence property consisting of a house and lot in _________.

2. B, in consideration of $_____ and of the other agreements above mentioned, waives, disclaims, and releases all right, title, and interest, in and to any and all of the real and personal property owned or possessed by A, at the time of the marriage, or that A may acquire by any means, and in which she may or might lawfully and rightfully acquire any title or interest by virtue of the marriage. B acknowledges that she knows A is the owner of _________ acres of land in _________ county, _________, and a residence property consisting of a house at _________, and _________ and a small amount of personal property.

The intention is to leave the absolute disposal of the real and personal property now owned or later acquired by either of them, so that at the death of the parties, all of the property of the parties, respectively, shall descend, or be disposed of by will, to his or her lawful heirs, legatees or devisees, released and acquitted of all claims of dower, curtesy, homestead, or other interest of any kind or nature, that either might have had under the laws of _________.
