Judgments.

[Another form] This day came again the petitioner by _________, her attorney and it appearing to the court that the respondent has had due notice of the pendency of this suit by personal service according to the statute in such case made and provided, that the respondent filed his appearance by attorney _________ and the parties having entered into a written agreement as to their rights.

And the court having heard the testimony of witnesses taken in open court, in support of petitioner's petition (a certificate of which evidence is filed with this judgment), and now being fully advised in the premises, finds that it has jurisdiction of the parties and the subject matter; that the petitioner was domiciled in the State of _________ at the time the petition was filed and has been domiciled in the State of _________ for over _________ days prior to the date of the hearing; that the parties were lawfully married on _________, 19__, and the certificate was registered at _________, _________, that subsequent to their marriage, the respondent, without fault on the part of the petitioner has been guilty of wilful desertion of the petitioner, without reasonable cause for the period of more than one year, as stated in the petition filed in this action.

The court finds that there was one child born to the parties as a result of the marriage, _________, age _________ years, that none were adopted by them and the petitioner is not now pregnant by the respondent.

The court finds that the parties have entered into a written agreement concerning the questions of the custody, visitation and support of the minor children of the parties, the maintenance of the petitioner and the respondent, the respective rights of each party in and to the property, income or estate which either of them now owns or may acquire, including a division of all marital and nonmarital property, and other matters, which agreement was admitted into evidence at the hearing in this action and was entered into by the parties freely and voluntarily without any collusion as to any dissolution proceedings between the parties to this action, that the agreement is fair and equitable to the parties, who have had benefit of counsel and have indicated that they understand all the provisions of it and wish to be bound by them and that the agreement is not unconscionable and the agreement is approved by the court.

On motion of attorney for the petitioner, it is therefore ordered, adjudged and decreed and this court by virtue of the power and authority vested in it and the statute in such case made and provided orders, adjudges and decrees that the bonds of matrimony existing between _________ and _________ be dissolved as to both parties and the same are dissolved accordingly.

It is further ordered, adjudged and decreed that the agreement entered into by the parties is adopted as a part of this judgment and shall be incorporated in it directly and by reference and shall be binding upon the parties and is in words and figures as follows: [Agreement is in §5.898.]
